Les évolutions considérables des sciences et des techniques biomédicales, remettent en question les principes les plus fondamentaux de l'ordre juridique. Alors qu'un débat est aujourd'hui engagé sur la révision de la législation française relative à ces questions, tant au sein du Parlement que dans l'opinion publique au travers d'États généraux, cet ouvrage a pour ambition tant de dresser un bilan des pratiques qu'une réflexion sur les enjeux sociaux et en termes de droits fondamentaux. La première partie expose le système normatif de la bioéthique. Sont revisités dans une deuxième partie les grands principes qui sont censés encadrer l'évolution des pratiques (dignité, liberté, principe de précaution...). Enfin, la troisième partie s'attache à analyser certaines pratiques, en particulier, le diagnostic prénatal, le clonage, les tests génétiques, la recherche sur les embryons, ou certaines questions comme celles de l'euthanasie ou des mères porteuses, au regard des incidences qu'elles ont sur l'homme qui peut être ainsi sélectionné ou instrumentalisé. Enfin, la réflexion se clôt sur des questions, comme celles relatives aux neuros sciences ou aux rapports entre l'homme et l'animal, et s'ouvre de manière prospective sur le destin de l'homme qui est incontestablement en jeu.
